AI & Data Policy

This AI & Data Policy explains how ShotTrack Pty Ltd ("ShotTrack", "we", "our" or "us") collects, processes and uses operational data, analytical outputs and artificial intelligence technologies across the ShotTrack product ecosystem, including the ShockAI platform.

This Policy should be read together with our Privacy Policy, Products & Services Terms and Website Terms of Use.

1. Purpose

ShotTrack develops technology that assists customers in monitoring, analysing and understanding vibration, environmental and engineering data.

Artificial Intelligence ("AI"), machine learning and advanced analytics are incorporated into selected Products and Services to assist customers in monitoring, analysing and understanding engineering and environmental data, improve operational decision-making, develop predictive insights and continuously enhance the ShotTrack platform.

This Policy explains:

  • how operational data is used;
  • how AI features operate;
  • what data remains the Customer's property;
  • how AI models are developed;
  • how Customer data is protected;
  • the limitations of AI-generated outputs.

2. Scope

This Policy applies to:

  • ShotTrack Hardware;
  • ShockAI cloud services;
  • desktop applications;
  • mobile applications;
  • APIs;
  • artificial intelligence services;
  • machine learning services;
  • predictive analytics;
  • automated reporting;
  • cloud processing services.

3. Definitions

For this Policy:

AI means artificial intelligence, machine learning, statistical modelling, predictive analytics and automated decision-support technologies.

Customer Data means all operational, engineering, environmental and project information uploaded to or generated through ShotTrack Products or Services.

Operational Data includes vibration measurements, waveform data, environmental monitoring information, project information, uploaded blast plans, calculated outputs and associated engineering records.

Model means a machine learning or artificial intelligence model developed or operated by ShotTrack.

4. Ownership of Customer Data

The Customer retains ownership of all Customer Data.

ShotTrack does not acquire ownership of Customer operational data.

Nothing in this Policy transfers ownership of Customer Data to ShotTrack.

Customers remain responsible for ensuring they have all necessary rights and permissions to upload Customer Data.

5. Licence to Process Data

To provide our Products and Services, Customers grant ShotTrack a limited, non-exclusive, worldwide licence to:

  • receive Customer Data;
  • store Customer Data;
  • process Customer Data;
  • analyse Customer Data;
  • generate reports;
  • perform calculations;
  • create visualisations;
  • provide technical support;
  • maintain backups;
  • operate cloud infrastructure.

This licence exists solely for the purpose of providing the contracted Products and Services.

6. Types of Data Processed

Depending upon the Products used, Customer Data may include:

  • vibration waveforms;
  • peak particle velocity;
  • acceleration measurements;
  • displacement calculations;
  • frequency analysis;
  • overpressure measurements;
  • GPS coordinates;
  • timestamps;
  • equipment identifiers;
  • project names;
  • monitoring locations;
  • uploaded blast plans;
  • geological information;
  • engineering notes;
  • photographs;
  • uploaded documents;
  • compliance reports.

Not all Products collect every category of information.

7. AI Features

ShotTrack AI may provide functionality including:

  • automated waveform interpretation;
  • vibration trend analysis;
  • exceedance prediction;
  • engineering recommendations;
  • automated report generation;
  • project summaries;
  • anomaly detection;
  • predictive maintenance insights;
  • compliance assistance;
  • future AI-powered engineering tools released by ShotTrack.

Feature availability depends upon subscription level and Product compatibility.

8. Human Oversight

AI outputs are designed to assist qualified users.

AI does not replace:

  • engineering judgement;
  • regulatory compliance;
  • safety assessments;
  • operational decision-making;
  • site-specific expertise.

Customers remain solely responsible for reviewing and validating all AI-generated outputs before relying upon them.

ShotTrack recommends that AI-generated information always be considered alongside engineering expertise and site-specific conditions.

9. Customer-Specific AI Models

Where separately agreed in writing, ShotTrack may develop Customer-specific AI models using that Customer's operational data.

Unless expressly authorised by the Customer:

  • Customer-specific models remain isolated from shared AI systems;
  • Customer operational data is not incorporated into shared training datasets;
  • Customer-specific models are not made available to other customers.

Ownership, licensing and commercial rights relating to Customer-specific AI developments will be governed by the applicable commercial agreement.

10. General AI Improvement

ShotTrack continually develops and improves its Products, Services, analytical models, artificial intelligence systems and machine learning capabilities.

Unless otherwise agreed in writing, Customer Data remains the property of the Customer.

ShotTrack will not use Customer-identifiable operational data to develop or train AI models that are made available to other customers unless the Customer has expressly agreed in writing or has enabled that use through an available platform setting.

ShotTrack may, where permitted by applicable law, use information that has been aggregated, anonymised or de-identified so that neither the Customer nor any individual can reasonably be identified for purposes including:

  • improving Products and Services;
  • enhancing software performance;
  • improving AI models;
  • developing new analytical capabilities;
  • improving system reliability;
  • improving cyber security;
  • conducting internal research and development;
  • generating industry benchmarking and statistical insights.

ShotTrack will take reasonable steps to ensure that de-identification processes are appropriate for the nature of the information being used.

Nothing in this clause transfers ownership of Customer Data to ShotTrack.

11. AI Limitations

Artificial intelligence and machine learning technologies are designed to support, not replace, informed human decision-making.

AI-generated outputs are based on the information available at the time of processing and may be affected by:

  • incomplete or inaccurate input data;
  • incorrect equipment installation;
  • sensor placement;
  • environmental conditions;
  • communication interruptions;
  • data quality;
  • software configuration;
  • limitations inherent in predictive modelling.

Accordingly, AI outputs should be regarded as advisory information only.

ShotTrack does not warrant that AI-generated outputs will be:

  • correct;
  • complete;
  • suitable for every application;
  • free from error;
  • capable of predicting future events with certainty.

12. No Automated Decision-Making

ShotTrack AI is designed as a decision-support tool.

Unless expressly stated for a particular Product or Service, ShotTrack does not use AI to make fully automated decisions that have legal, regulatory, employment or similarly significant effects on individuals.

Operational decisions remain the responsibility of the Customer and its authorised personnel.

13. Transparency

Where AI-generated outputs are presented within ShotTrack Products or the ShockAI platform, they will, where reasonably practicable, be identifiable as AI-assisted outputs.

ShotTrack aims to provide users with sufficient context to understand:

  • the purpose of AI-generated outputs;
  • the nature of predictions or recommendations;
  • known limitations;
  • appropriate interpretation of results.

The level of explanation provided may vary depending on the Product, subscription level and technical complexity of the analysis.

14. Customer Responsibilities

Customers using AI-enabled Products or Services agree to:

  • review AI-generated outputs before relying upon them;
  • ensure uploaded information is accurate and complete;
  • maintain appropriate engineering oversight;
  • comply with applicable laws and industry standards;
  • ensure only authorised personnel use AI features;
  • report suspected system errors where reasonably practicable.

Customers remain solely responsible for operational, engineering, commercial and regulatory decisions based on AI-generated information.

15. Security of AI Processing

ShotTrack applies appropriate administrative, technical and organisational measures to protect Customer Data processed by AI systems.

These measures may include:

  • encrypted communications;
  • secure cloud infrastructure;
  • authentication controls;
  • access logging;
  • role-based permissions;
  • monitoring for unauthorised access;
  • regular software updates;
  • security reviews.

While reasonable security measures are implemented, no internet-connected system can be guaranteed to be completely secure.

16. Data Retention

Customer Data processed by AI systems is retained only for as long as reasonably necessary to:

  • provide contracted Products and Services;
  • maintain customer accounts;
  • support reporting functions;
  • enable disaster recovery;
  • satisfy legal and regulatory obligations;
  • resolve disputes;
  • enforce contractual rights.

Retention periods may differ depending on:

  • subscription level;
  • customer configuration;
  • contractual requirements;
  • legal obligations.

Where Customer Data is no longer required, it will be securely deleted, anonymised or otherwise disposed of in accordance with our internal data management procedures.

17. International Processing

ShotTrack provides Products and Services to customers in multiple countries.

Customer Data may therefore be processed using cloud infrastructure located in Australia or other jurisdictions utilised by our approved service providers.

Where international processing occurs, ShotTrack takes reasonable steps to ensure that Customer Data is protected by appropriate contractual, organisational and technical safeguards.

International processing does not affect Customer ownership of Customer Data.

18. Ethical AI Principles

ShotTrack is committed to developing AI technologies that are:

  • transparent;
  • reliable;
  • secure;
  • accountable;
  • privacy-conscious;
  • human-centred;
  • commercially responsible.

We aim to ensure AI assists users without replacing appropriate professional judgement.

As our AI capabilities evolve, we will continue to review our governance processes and development practices to support responsible innovation.

19. Model Improvements

ShotTrack continually develops, refines and improves its analytical methods, algorithms and artificial intelligence capabilities.

These improvements may include:

  • enhanced prediction accuracy;
  • improved analytical models;
  • new engineering insights;
  • improved report generation;
  • expanded monitoring capabilities;
  • enhanced compliance tools;
  • improved fragmentation and vibration prediction models;
  • enhanced site-specific learning capabilities;
  • improved processing performance;
  • improved security;
  • software enhancements.

Where appropriate and permitted by law, improvements may be informed by aggregated or de-identified operational information collected across the ShotTrack platform.

Updates may be deployed periodically to improve reliability, functionality, security and customer experience.

Where changes materially affect customer functionality or workflows, ShotTrack will use reasonable efforts to provide advance notice.

20. Liability

AI-generated outputs are provided to assist qualified users and should not be relied upon as the sole basis for operational or engineering decisions.

To the maximum extent permitted by law, ShotTrack is not liable for losses arising from decisions made solely or primarily on the basis of AI-generated recommendations, predictions or analytical outputs.

Nothing in this Policy excludes rights or remedies that cannot lawfully be excluded under applicable legislation, including the Competition and Consumer Act 2010 (Cth).

21. Changes to this Policy

ShotTrack may amend this AI & Data Policy from time to time to reflect:

  • changes in technology;
  • legislative developments;
  • enhancements to AI capabilities;
  • changes to our Products or Services;
  • improvements to our governance practices.

The current version will always be available on the ShotTrack website.

Where changes materially affect Customers, we will take reasonable steps to notify affected users through appropriate communication channels.

This AI & Data Policy forms part of the ShotTrack Legal & Trust Framework and should be read together with:

Where a separate written agreement governs the development of Customer-specific AI models or other bespoke data services, that agreement prevails to the extent of any inconsistency.

24. Governing Law

This Policy is governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.
